At CrossWeb Creations, we strive to keep to keep things simple and transparent, and that includes our terms of service. We want to answer all your questions in straightforward language, so that you’ll feel comfortable doing business with us and recommending us to your friends.

What you need to know

 

Content Ownership

Everything, including all content, images, and domain names, related to you website is completely owned and controlled by you. You can request a backup of your intellectual property at any time.

Privacy

Your privacy is extremely important to us. Any information collected about clients or potential clients will only be used within the company, and never shared with outside sources. The type of information collected primarily includes names, email addresses, website adresses, phone numbers, location, and business name. This information is solely used for building websites and communications from CrossWeb Creations. A testimonial and link to your new website may be used on our page showcasing our work, but only with your consent.

Cancellation Policy.

If you are unsatisfied with our service, you may cancel your hosting and admin account with us at any time by sending notice to “cancel@crosswebcreations.com”. All content on your website is yours to keep.  You will be assessed a $150 cancellation fee to cover the labor involved with archiving and transferring all the necessary files to the destination of your choice. You will receive all files within three business days of the cancellation fee being paid.

Unlimited Updates

The Business Pro hosting plan includes unlimited updates of your site. This truly means as many updates and changes as you need to be completely satisfied. CrossWeb Creations does reserve the right, at our discretion, to downgrade accounts to the Business hosting plan (one hour of free updates), if the update requests are exercise, redundant, or so continually time-consuming they degrade our ability to provide outstanding service to all of our clients. In this unlikely scenario, we will notify the client mid-billing cycle and explain our concerns. If an understanding cannot be reached, the account will be downgraded at the start of the next billing cycle.

Using a Preexisting Domain Name

If you have previously registered a domain name with another provider and want to use it with hosting from CrossWeb Creations, you must request that the existing registrar change the name servers for the domain name as designated by your project manager.

Please note you will still be responsible for all ongoing fees for that domain name with your existing registrar. The hosting fee paid to CrossWeb Creations does not included registration or renewal fees for your preexisting domain names.

Indemnity

You agree to indemnify CrossWeb Creations (the Company) for certain of your acts and omissions. You agree to indemnify, defend, and hold harmless Company, its affiliates, officers, directors, employees, consultants, agents, and representatives from any and all third party claims, losses, liability, damages, and/or costs (including reasonable attorney fees and costs) arising from your access to or use of the Site, your violation of these Terms of Use, or your infringement, or infringement by any other user of your account, of any intellectual property or other right of any person or entity. Company will notify you promptly of any such claim, loss, liability, or demand, and will provide you with reasonable assistance, at your expense, in defending any such claim, loss, liability, damage, or cost.

No Warranties

COMPANY HEREBY DISCLAIMS ALL WARRANTIES. COMPANY IS MAKING THE SITE AVAILABLE “AS IS” WITHOUT WARRANTY OF ANY KIND. YOU ASSUME THE RISK OF ANY AND ALL DAMAGE OR LOSS FROM USE OF, OR INABILITY TO USE, THE SITE OR THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SITE, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. COMPANY DOES NOT WARRANT THAT THE SITE OR THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SITE OR THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

Limited Liability

COMPANY’S LIABILITY TO YOU IS LIMITED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL COMPANY BE LIABLE FOR DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, OR LOST DATA, REGARDLESS OF THE FORESEEABILITY OF THOSE DAMAGES) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR ANY OTHER MATERIALS OR SERVICES PROVIDED TO YOU BY COMPANY. This limitation shall apply regardless of whether the damages arise out of breach of contract, tort, or any other legal theory or form of action.
